Terms of use and sale

1. Purpose

These terms govern access to and use of the PIPSTER PRO service (the "Service"), published by Online Hospitality SARL, whose registered office is at Rue Loubnane, Immeuble 10, Appartement 15, Guéliz, Marrakech, Maroc, available at https://pipster.ch. Creating an account, like taking out a subscription, constitutes unreserved acceptance of these terms.

2. Nature of the service

The Service is a technical analysis tool for financial markets. It applies deterministic calculation rules to market data and displays the result: trend, structure, zones, theoretical entry, stop and target levels, together with the reasons why an entry is advised against.

The Service provides no investment advice, no personal recommendation and no portfolio management. The publisher is neither an investment services provider nor a financial investment adviser.

The PIPSTER PRO terminal executes no orders and is connected to no broker. MetaTrader 5 automation is a separate optional module, subscribed to separately, installed and configured by the user on their own platform and under their sole responsibility; it is covered by article 6.

3. User account

  • Accounts may only be opened by natural persons of legal age and legal capacity.
  • An account is strictly personal; sharing it between several users is prohibited.
  • The user is responsible for keeping their password confidential and for actions carried out from their account.
  • The email address must be confirmed in order to access the terminal.
  • The publisher may suspend an account in the event of abusive use, sharing, attempts to circumvent technical limits, or non-payment.

4. Plans, prices and payment

The Service is offered in three plans — Discovery (free), Pro and Elite — alongside modules sold separately. The prices in force are those displayed on the Pricing page at the time of subscription.

Paid subscriptions are taken out for monthly or annual periods and renew automatically until cancelled. Payment is taken as soon as the subscription is made: no free trial period is attached to a paid subscription.

Payments are processed by Stripe. No bank card data is collected or stored by the publisher. An invoice is made available in the customer area after each payment.

Prices are displayed in EUR. No tax is added at the time of payment. Where the regulations applicable to the user place a tax on them in respect of this purchase, that tax is their responsibility.

5. Term, cancellation and refund

A subscription may be cancelled at any time from the customer area, without reason and without charge. Cancellation takes effect at the end of the current period: access is maintained until that date, after which the account returns to the Discovery plan. No pro rata refund is made for the period already started.

A user subscribing for the first time may request a full refund of their first payment within fourteen days of that payment, by writing to support@pipster.ch. No reason need be given. The refund is made to the original payment method; paid access ends on that date.

This option is offered contractually by the publisher. It is in addition to, and does not replace, the rights that the law applicable to the consumer grants them on a mandatory basis: nothing in these terms deprives a consumer of a right that their national law does not allow them to waive.

6. MetaTrader 5 automation module

The publisher makes available, optionally and under a separate subscription, a program for the MetaTrader 5 platform capable of transmitting orders to the broker chosen by the user. This module forms part of no plan: it is subscribed to separately and downloaded from the customer area.

The module ships in logging mode: in that state it records what it would have done without transmitting a single order. Switching to live execution is an explicit action by the user, performed in the settings of their own platform. The publisher recommends doing so only after a period of observation on a demo account.

The user remains solely responsible for installing, configuring, monitoring and stopping the module, for choosing their broker, for position sizes and for the losses that result. The publisher has access neither to the brokerage account, nor to the orders, nor to the user's funds, and can neither interrupt nor correct an execution in progress.

A malfunction of the platform, the terminal, the connection, the broker or the module itself may lead to orders that are not transmitted, transmitted twice, transmitted at a price other than the one expected, or not closed. The user acknowledges this risk and undertakes not to leave the module running unattended.

7. Availability

The publisher uses reasonable means to ensure the availability of the Service, without any obligation to achieve a particular result. The Service depends on third-party data providers whose interruptions, delays or errors cannot engage the publisher's liability. Interruptions for maintenance may occur.

8. Limitation of liability

The user acknowledges that any investment decision is their sole responsibility. The publisher cannot be held liable for financial losses, direct or indirect, resulting from use of the Service, from an error or delay in data, from an incorrect signal, from unavailability, or from the operation of the automation module.

In any event, and save for gross negligence or wilful misconduct, the publisher's liability is limited to the sums actually paid by the user over the last twelve months. This limitation does not apply where the applicable law prohibits it.

9. Intellectual property and permitted use

All elements of the Service — code, interface, algorithms, content, trademark — remain the exclusive property of the publisher. A subscription confers a personal, non-exclusive and non-transferable right of use. The following are prohibited in particular: reselling access, mass automated extraction of the data displayed, redistribution to third parties of the quotes or decisions produced by the Service, and reverse engineering of it.

10. Personal data

The processing of personal data is described in the privacy policy, which forms an integral part of these terms. Privacy policy.

11. Changes to the terms

The publisher may amend these terms. Users are informed by email or within the application at least fifteen days before a substantial change takes effect. Continued use after that date constitutes acceptance; failing that, the user may cancel free of charge.

12. Governing law and disputes

These terms are governed by Moroccan law. Failing an amicable settlement, the competent courts are those of Marrakech.

This clause does not affect mandatory rules protecting consumers: a user acting for non-professional purposes retains the benefit of the mandatory provisions of the law of their country of residence and, where applicable, the right to bring proceedings before the courts of that country.
